Vermont legalizes marijuana: Bill H.511

Vermont Bill H.511 legalizing marijuana passed the General Assembly and awaits signing by Gov. Phil Scott, a Republican who says he’ll do it. The law lets you possess up to one ounce of cannabis or five grams of hash. You can even grow and harvest two mature plants in your home. It doesn’t matter if you intend recreational use or medical use.

Legal: 1 oz flower, 5g hash, 2 mature plants

The main thrust of Vermont marijuana law H.511 is contained in section 4230(a)(1)(A):

No person shall knowingly and unlawfully possess more than one ounce of marijuana or more than five grams of hashish or cultivate more than two mature marijuana plants or four immature marijuana plants…

And also Section 4230a.(a)(1)(a):

… a person 21 years of age or older who possesses one ounce or less of marijuana or five grams or less of hashish and two mature marijuana plants or fewer or four immature marijuana plants or fewer or who possesses paraphernalia for marijuana use shall not be penalized or sanctioned in any manner by the State or any of its political subdivisions or denied any right or privilege under State law…

There are additional public safety limitations. A person cannot be under the influence or consuming marijuana while operating a motor vehicle. A person also cannot consume cannabis or hash in a public place:

“Public place” means any street, alley, park, sidewalk, public building other than individual dwellings, any place of public accommodation as defined in 9 V.S.A. 4501, and any place where the use or possession of a lighted tobacco product, tobacco product, or tobacco substitute as defined in 7 V.S.A. 1001 is prohibited by law.

No licensing structure for a regulated industry

Many commentators have hailed Vermont’s law as a remarkable achievement- the first time a state legislature has passed a recreational use law without the People having to demand it by ballot initiative. However, the law provides no regulatory system to license cultivators, processors, and dispensaries.

“A lot of work has taken place, but we’re still not there yet,” Democrat Sen. Richard Sears said. “I don’t think we’re there until we see a tax and regulated system.” – according to The Daily Caller.

Protections for Landlords and Employers

H.511 includes provisions that grant landlords and employers protections against marijuana use on their property, should they choose to avail themselves of it. For landlords, the relevant section is 4230a.(b)(2)(E): “This Section does not prohibit a landlord from banning possession or use of marijuana in a lease agreement.”

For employers, the relevant section is 4230a.(e):

Nothing in this section shall be construed to do any of the following:

(1) require an employer to permit or accommodate the use, consumption, possession, transfer, display, transportation, sale, or growing of marijuana in the workplace;

(2) prevent an employer from adopting a policy that prohibits the use of marijuana in the workplace;

(3) create a cause of action against an employer that discharges an employee for violating a policy that restricts or prohibits the use of marijuana by employees; or

(4) prevent an employer from prohibiting or otherwise regulating the use, consumption, possession, transfer, display, transportation, sale, or growing of marijuana on the employer’s premises.

Dispensaries Open in Maryland so far

The first several dispensaries have opened to patients in Maryland, but products will be scarce and expensive for a while. Regulars could give final approval to dozens more dispensaries in the next few months, but not all owners will want to hurry until there is a consistent supply of finished products and plant material from the licensed growers and processors.

Maryland Market Basics

Registration of patients commenced in April 2017. Approximately 18,000 patients have registered successfully so far, according to the Baltimore Sun, citing officials at the Medical Cannabis Commission. Another 5,000 patient applications are currently in progress.

Nearly all of the licensed growers and processors have been approved to commence operations now, but it is difficult to know how well and fast each company is proceeding. Most growers could not have begun production until late summer, therefore most probably have not yet produced a first harvested batch for sale to a processor or dispensary.

The Baltimore Sun does a good job capturing the scene as we head into the new year:

ForwardGro, the first grower to start cultivating, sent its first batches to processors to get turned into products, said CFO Gail Rand. A new batch of flowers should be available for processors and dispensaries within days or weeks, Rand said Thursday.

Bryan Hill’s Charm City Medicus dispensary in Dundalk was among the dozen approved to operate Thursday, but he said he doesn’t expect to have cannabis available until January.

He doesn’t want to open his doors and run out, the way several other dispensaries did earlier this month.

Ohio has published the names of processor applicants. 104 companies are competing for 40 licenses. The list includes many companies who would be local Ohio startups. There are also many companies who already manage licensed businesses in one or more other states. All 12 of the companies recently pre-approved for level I cultivation in Ohio are in the mix, so are 7 of the companies pre-approved for level II cultivation.

In Ohio, cultivators legally do not hold a license yet but have been pre-approved. Marijuana Jobs at Maryland Growers, Processors, Dispensaries

Hiring for marijuana jobs in Maryland is about to pick up. Several licensed grower and processor businesses have already hired many workers, and recently the first dispensaries opened their doors to paying customers. Jobs creation has only just begun though. Marijuana cultivation licenses Level I were issued on November 30, 2017. Among the 12 large scale growers are three with vertically integrated businesses in multiple states- Columbia Care, Terradiol, and Cresco Labs.

Ohio’s Medical Marijuana Law permits Level I cultivators to utilize up to 25,000 sq ft of canopy space. The law also creates a separate class of smaller cultivators, Level II, which are permitted to grow up to 3,000 sq ft of canopy space. Ohio awarded provisional licenses to Level II cultivators last month.

PA dispensary companies may open three facilities each for selling medical marijuana products to registered patients. Five  companies are vertically integrated in Pennsylvania, meaning they are licensed to both produce and distribute products– a significant market advantage. A dispensary that is not vertically integrated must negotiate the purchase of all of inventory. But a dispensary that is vertically integrated acquires much of its inventory in-house, thereby generating greater profit. Another advantage of vertical integration is that a dispensary can better tweak its discounts, promotional materials, and other incentives to build customers preference for the products it produces in-house.

Illinois needs more dispensaries if recreational use passes

53 dispensaries are open in Illinois. They sell amazing varieties and qualities of medical cannabis products in the form of flower, edibles, and oils, but only to registered patients, of which there are 27,000. Illinois dispensaries earned their licenses through a competitive application process that culminated in February 2015. The first dispensaries opened for business in November that same year, and there has been a steady progression of openings ever since.

How would legalizing recreational use affect Illinois dispensaries?

Illinois might go rec soon. There is presently an enabling act in the legislature, and there could be a voter initiative on the ballot in March 2018.

It’s easy to agree legalizing recreational use is desirable but hard to decide the best way to implement legalization. For example, what should the licensing framework for producers (cultivation centers) and sellers (dispensaries) look like?

Because the size of the market is artificially constrained by difficult registration standards for patients, removing the constraints will cause an immediate explosion in the size of the market. Does that justify lifting the law’s cap on the maximum number of cultivation center licenses? Or does the small class of original licensees under the medical cannabis law deserve exclusivity?

In the case of dispensaries, the number of licenses must surely be increased to meet the sudden new demand. 53 dispensaries is more than enough when the market is less than 30,000 consumers, but recreational use will explode the market fivefold. Congestion at the dispensaries and surrounding areas will be unbearable unless the number of dispensaries increases.
